About Our Mail Order Service

We aim to deliver the best possible customer experience and we therefore adhere to all current and proposed legislation in addition to trade body guidelines. The conditions detailed below do not affect your statutory rights. These include all of the current guidelines relating to the information that we hold about you and, in order to clarify this, we have a published privacy statement.

Products

All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available. Products and packaging are subject to change or substitution without prior notice. Every effort will be made to dispatch the items specified. Back Orders

If an item is out of stock we will email you with the option either to cancel your order or, having told you when we can fulfill it, to wait for delivery.

Pallet Deliveries - 1 man delivery service for large furniture sets and Barbeques

The majority of garden furniture sets and Barbecues will be delivered on a wooden pallet, this is to ensure that your order arrives in perfect condition.

The delivery driver will not be able to carry the items up or down steps, carry the items through a property, wheel the pallet across a gravel driveway or up particularly steep driveways. Unfortunately the delivery company will be unable to remove items from the pallet or take the pallet away with them. The driver will normally only be able to wheel the pallet as far as physically possible which may even be the kerbside.

On pallet deliveries please assume the delivery will be made on a long heavy goods vehicle, please contact us if there are weight, height or parking restrictions or difficult access points before your order is despatched so that we can make alternative arrangements, failure to do so may result in a failed delivery and re-delivery charge.

Pallet deliveries cannot be made :

  • On to soft ground such as grass, gravel, or soil.
  • To a premises where it is illegal for a lorry to park or offload.
  • Where the surface of the access road is very unstable, soft or muddy.
  • Where the access road is on a steep incline.
  • Where the access road does not provide 10 feet (3.05m) width clearance and 14 feet (4.27m) vertical clearance.

Methods of Payment

We can only accept payment in pounds Sterling. We accept Visa, Mastercard, Maestro, Switch, Delta, American Express and PayPal. All prices are inclusive of VAT (where applicable) at the current rate and are correct at the time of input. Some products contain some zero rated goods and the consolidated VAT rate is then reduced accordingly. We reserve the right to amend prices subject to change in the rate of duty. The total cost of your order is the price of the products including delivery charges. All orders are positively credit card sanctioned prior to dispatch, so please ensure that the details you provide us with are correct. We cannot accept responsibility for an order being held back as a result of incorrect or invalid payment details being given. In the unlikely event that your payment card is used fraudulently to make a purchase with Swallow Aquatics, you, the consumer, are entitled to cancel the said payment(s).

If payment has already been made, you, the customer, are entitled, in accordance with the standing Consumer Protection Distance Selling Regulation (2000), to a re-credit or to have all sums returned to you by the card issuer.

Cancelling your Order

We operate a policy for cancellation to allow you a cooling off period after placing your order. In accordance with the Distance Selling Directive (2000) you may cancel your order at any time without reason within 7 working days of delivery. You may cancel your order for any reason provided:

  • You or the recipient notifies us of your cancellation in writing/ email to the address on our “contact us" page within seven working days of delivery.
  • The goods remain unused and component parts are unopened.
  • You or the recipient retain and take reasonable care of the goods until returned.
  • You return packaged item(s) to Swallow Aquatics.
  • Please be aware that you will be responsible for any postage/carrier costs incurred in sending goods back to the Swallow Aquatics. We recommend that items being returned be sent via insured, trackable delivery for your protection. A refund can only be provided for items received back by us.

On receipt of the goods, Swallow Aquatics will give you a full refund of the amount paid (less the delivery charge) or an exchange/credit as required. Refunds can only be credited back to the original card that the goods were bought with. Please note that refunds for items bought as gifts can only be given to the original payer, and that if you decide to swap an item we can’t stop the payer knowing. On return of goods on which you have received a discount/offer, that discount/offer will no longer apply if you fall below the discount /offer threshold. Swallow Aquatics can arrange for delivery of replacement products to you if required; this constitutes a separate contract between you and Swallow Aquatics. In this case, a charge will be made by Swallow Aquatics for packing, handling and delivery of goods. This does not affect your statutory rights.

You will receive an email to confirm that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice.

This term is included to protect us from any errors made in the pricing of goods, or in case we are no longer able to supply a particular product for some reason. If a price has changed we will always contact you first to ensure that the price is acceptable.

Refunds and Exchanges

Should you find that the goods you’ve purchased from us are unsuitable etc, they can be returned for a prompt refund or exchange if they are received back at the address below within 21 days, in new condition, with the original packaging, labelling and Swallow Aquatics receipt. The 21 days start from the day of dispatch, but as a minimum includes a period of 7 working days from the day after delivery to you as the permitted cancellation period. We will provide a refund or exchange within 30 days of receiving the returned goods. We recommend that items being returned be sent via insured, trackable delivery for your protection. All return postage charges must be met by the customer, unless he or she is returning the goods due to a fault. In the case of warranty returns, goods must be clean and free from dirt to comply with the current Health and Safety Regulations. DVDs, videos and books are non-exchangeable and non-returnable, unless incorrect or defective. All of the above does not affect your statutory rights as a consumer.
